Terms of Service
Effective date: not yet set — these terms have not been signed

These terms are an agreement between you and Ingenius LLC, a Delaware limited liability company (“Pigeon”, “we”, “us”), and they govern your use of pigeonnewspaper.com, the Pigeon applications, and everything we publish through them (together, the “Service”).

By using the Service, or by creating an account, you agree to these terms. If you do not agree, do not use the Service.

Two other documents form part of this agreement and you should read them: our Privacy Policy and our Refund Policy. If you subscribe, the subscription terms shown on the payment screen and in your confirmation email are also part of this agreement, and if they conflict with anything here, those terms win for that subscription.

1. Who may use Pigeon

You must be at least 18 years old, or old enough to enter a binding contract where you live, whichever is greater. The Service is offered to readers in the United States. You must not use the Service if you are barred from doing so under United States law.

2. Your account

You are responsible for your account and for anything done through it. Keep your password to yourself. Tell us promptly at editor@pigeonnewspaper.com if you believe someone else has it.

One account is for one person. Do not share your account credentials with other people. We may close an account we reasonably believe is being shared or resold.

You may delete your account at any time from your profile page. Deleting your account does not by itself cancel a paid subscription bought through Apple; see §5.

3. What we publish, and what we do not

Pigeon publishes facts: events, statements, and links to primary sources. We do not publish opinion pieces. We may add, remove, or change sections, features, formats, and how often we publish.

We aim to be accurate. When we get something wrong, we correct it and we publish the correction. If you believe a story is wrong, tell us — there is a “Report a problem” control on every screen, and you can write to editor@pigeonnewspaper.com.

4. Subscriptions, trials, and billing

The current prices, the length of any free trial, the date of your first charge, and the renewal terms are shown to you on the payment screen before you enter a card, and again in the confirmation email we send you immediately afterwards. Read them. They are the operative terms of your subscription. In summary, and subject to what that screen says:

  • A subscription renews automatically at the end of each term, at the then-current price, until you cancel.
  • You can cancel at any time, online, from your profile page, in no more steps than it took to subscribe.
  • If you cancel, you keep access until the end of the term you have already paid for, and you are not charged again.
  • If we change the price, we will tell you by email before the new price is charged, with the notice period the law requires, and you can cancel before it takes effect.

Refunds are governed by our Refund Policy.

Lifetime access (beta)

Lifetime access means your one-time payment covers your account for as long as Pigeon News exists — no monthly or yearly charge, ever, as one of the first 100 subscribers. It does not mean every feature stays exactly the same forever: sections, formats, and tools can change over time, the same as any newspaper changes over the years. If Pigeon News ever shuts down, your lifetime access ends with it — we can’t promise something we’re no longer running.

What $2.99 gets you

$2.99 gets you the main newsfeed and the newspaper we email twice a week. It does not include phone or chat support — write to us and we’ll write back. It does not lock in every feature exactly as it is today — the paper will keep changing. And it is a one-time payment for access while Pigeon News is running, not a copy of the archive you keep if you cancel or if we ever close.

5. Subscriptions bought through Apple

If you subscribe inside our iOS app, Apple takes the payment and Apple manages the subscription. Apple’s terms apply to that transaction alongside these. Cancel an Apple subscription in your Apple account settings — we cannot cancel it for you, and deleting your Pigeon account will not stop an Apple charge. Refunds for Apple purchases are requested from Apple, not from us. Prices inside the app may differ from prices on our website.

6. Acceptable use

Do not:

  • copy, scrape, mirror, resell or redistribute Pigeon’s content beyond the personal use described in §7, or use it to train a machine-learning model;
  • use automated means to access the Service other than a normal browser or our apps, or to take more from the Service than a person reading it reasonably would;
  • interfere with the Service, attempt to gain access to accounts or systems that are not yours, or test our security without our written permission;
  • impersonate anybody, or use the Service to break the law;
  • remove or obscure any attribution, source link, or notice we publish.

We may suspend or close an account that breaks these rules. If we close a paid account for a breach, we will refund the unused part of the current term unless the breach involved fraud or an attempt to harm the Service or other readers.

7. What a subscription buys

We grant you a personal, non-exclusive, non-transferable, revocable licence to read and use Pigeon for your own non-commercial purposes while your subscription is active. You may share individual links and quote briefly with attribution, as anyone may with any publication.

You are not buying ownership, a permanent copy, or a right to republish. The Service, its text, design, code, name and logo belong to Ingenius LLC or to our licensors and are protected by copyright and trademark law. Material we quote or link to belongs to its own owners.

8. Pigeon is news, not advice

The Service is provided for general information. Nothing in it is financial, investment, legal, medical, tax, or professional advice of any kind, and nothing in it is a recommendation to buy, sell, or do anything. Market data, economic figures, and forecasts may be delayed, incomplete, or wrong.

Do not act on anything you read here without checking it yourself. We link the primary source on every story precisely so that you can. You are responsible for any decision you make.

9. Third-party links

Pigeon links out to primary sources and other publications. We do not control those sites, we are not responsible for them, and a link is not an endorsement. Some sources are behind a paywall; where we know that, we say so.

10. Copyright complaints

If you believe something we published infringes your copyright, write to legal@pigeonnewspaper.com with enough detail to identify the work and the material you say infringes it, your contact details, and a statement that you have a good-faith belief the use is not authorised. We will look at it promptly.

11. Changes to the Service and to these terms

We may change the Service. We may change these terms; when we do, we will post the new version with a new effective date, and for account holders we will email you before a material change takes effect. If you keep using the Service after that, you have accepted the change. If you do not accept it, stop using the Service and cancel — and if a material change to these terms lands mid-term on a paid subscription, write to us and we will refund the unused part of that term.

Price changes are not governed by this section. They are governed by §4 and by the notice we are required by law to give you.

12. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or end your access if you break these terms, if we are required to by law, or if we stop offering the Service. If we stop offering the Service, we will refund the unused part of any term you have paid for.

13. Disclaimers and limits on what we owe you

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, error-free, or that any story is complete or free of mistakes.

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the Service or these terms is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) one hundred dollars ($100). We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or lost opportunity, even if we were told they were possible.

Some states do not allow some of these exclusions. Where that is true, they do not apply to you and the rest still does. Nothing in these terms limits liability for fraud, or for anything that cannot be limited by law.

14. Disputes — arbitration and no class actions

Please read this section carefully. It affects how disputes between us are resolved and it limits your right to go to court or take part in a class action.

First, talk to us. Before starting a formal proceeding, write to legal@pigeonnewspaper.com describing the problem and what you want. We will try to resolve it within 30 days. Most things end here.

Arbitration. If we cannot resolve it, you and we agree that any dispute arising out of or relating to the Service or these terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted by a single arbitrator, in writing or by telephone or video unless the arbitrator decides an in-person hearing is needed, and if an in-person hearing is needed it will be held in the county where you live or somewhere else we agree. We will pay the arbitration filing and administration fees that the AAA’s consumer rules require us to pay. The Federal Arbitration Act governs this section.

Small claims. Either of us may instead bring an individual claim in small claims court, if it qualifies. Either of us may also ask a court for an injunction to stop misuse of intellectual property.

No class actions. You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims. If this paragraph is found unenforceable as to a particular claim, that claim — and only that claim — goes to court, and the rest of this section still applies to everything else.

You can opt out of this section. Send an email to legal@pigeonnewspaper.com with the subject line “Arbitration opt-out” and your account email address, within 30 days of first agreeing to these terms. That is all it takes. Opting out costs you nothing, changes nothing else about your account, and we will not treat you differently for doing it. If you opt out, §15 governs instead.

If this whole section is unenforceable, §15 governs instead.

15. Governing law and venue

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. For anything not resolved under §14, you and we submit to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.

This does not take away rights you have under the consumer-protection law of the state where you live, where that law says it cannot be waived.

16. The rest

These terms, together with the Privacy Policy, the Refund Policy, and the subscription terms shown at purchase, are the whole agreement between us about the Service. If any part is held unenforceable, the rest stands. If we do not enforce something straight away, we have not given it up. You may not transfer this agreement; we may transfer it to a successor if the business is sold, and we will tell you if that happens.
